Article 2 The housing construction and municipal infrastructure projects (hereinafter referred to as engineering projects) that must be subject to construction tendering in accordance with the law in the administrative area of ​​this Municipality shall determine the official bidders in accordance with these Provisions.
Article 3 The tenderee shall publish the tender notice and prepare the prequalification documents according to the regulations and procedures according to the scale and tender contents of the project.
Article 4 The prequalification of the construction project bidding shall be carried out by the tenderee or the entrusted bidding agency, and shall be supervised by the bidding supervision institution of the construction administrative department.
For prefectures (cities) with a tangible building market, prequalification activities should be conducted within the physical building market.
Article 5 The qualification level requirements for enterprises and registered construction engineers in the prequalification conditions shall be in accordance with the actual scale of the proposed bidding project, and shall not be arbitrarily raised or lowered.
If the registered construction engineer's work unit is changed, the registration certificate shall be changed. Otherwise, the tenderer should refuse.
Article 6 The bidding and supervising agency shall strengthen the supervision and management of the qualification examination.
The qualification materials include:
(1) reviewing the application form;
(2) Qualification certificate, business license, enterprise legal person certificate and safety production license;
(3) The financial status of the bidders;
(4) Qualification certificates or post certificates of registered construction engineers and other project management personnel (referred to as “five major members”, namely construction workers, safety officers, quality inspectors, material members, and information workers), as well as safety assessments of construction engineers and safety personnel. Certificate of conformity and safety training certificate;
(5) Project performance materials and award certificates;
(6) Other qualifications stipulated by laws and regulations.
All kinds of certificates and certificates used for qualification examination shall be originals. After the tenderee has verified the originals, a copy of the stamps of the bidders shall be filed.
Article 7 If the tenderer adopts the invitation method for bidding, it shall have more than 3 (including 3) qualifications for the construction bidding project, and the creditworthiness is good, and the city level or above is obtained within 24 months before the bid opening (including the opening of the standard month). The legal person including the municipal-level excellent engineering and civilized construction site will issue an invitation to bid and report to the bidding and tendering agency for the record.
Invited bidding involving real estate development projects, the construction engineer who invites to participate in the bidding must also obtain the performance of excellent engineering or civilized construction sites above the city level (including municipal level) within 24 months before the bid opening (including the opening of the standard month).
Article 8 If the tenderer adopts the public bidding method and adopts the bidding project with the lowest bid price method that has been evaluated, only the official bidders who enter the bidding process can enter the bid opening procedure, and the final bidders are determined as follows:
(1) Before the bid opening, when more than 3 (including 3) bidders submitting bid documents are less than 9 (including 9), all bidders shall be the final bidders;
(2) Before the bid opening, when there are more than 9 bidders (excluding 9) submitting the bidding documents, the random bidding method shall be adopted first, and 9 bidders who have submitted the bidding documents shall be identified as the finalists. The remaining bidders have obtained excellent projects at or above the provincial level (including provincial level) or excellent projects at the municipal level in Yichun City within 24 months prior to the opening of the bid, and the constructor who plans to send the bidding project is the award-winning engineering constructor. , added to the finalist of the final bidder. The official bidder who is added to the finalist shall provide the award certificate, the original and copy of the construction engineer certificate on the spot, and the bid evaluation committee shall examine the award certificate and the construction engineer certificate.
If the official bidder has not been identified as a finalist, the bid documents submitted will not be opened and will be returned to the bidder.
Article 9 The random selection of official bidders shall be conducted by the tenderee or the entrusted bidding agency and shall be conducted in the physical construction market. The whole process of the extraction activities shall be subject to the supervision of the bidding and tendering supervision agency and shall be carried out under the witness of the notary public.
Article 10 Bidders shall be punished by the competent administrative department of construction. They may not participate in the bidding if they have one of the following circumstances.
(1) Administrative penalties for project quality, safety accidents, and safety hazards, and the time limit is not full;
(2) The enterprise safety production license is temporarily suspended or revoked;
(3) The project that has not been tendered due to the acceptance of the bidding is punished, and the time limit is not full;
(4) If the enterprise defaults on the project due to its own reasons and the wages of the workers, causing petitions for petitions or causing adverse social impacts, the time limit is not satisfied;
(5) Being punished for violating the Tendering and Bidding Law and the construction market management laws and regulations or having other unhealthy market behaviors, and the time limit is not full.
Article 11 The tenderee shall properly keep the application materials and bidding materials submitted by all bidders, and shall not modify or destroy them. The application period for the application for bidding and the retention period of the bidding materials submitted by the bid applicant shall be implemented in accordance with the relevant provisions of the file management.
Article 12 If the bid applicant waives the bid after obtaining the bidding qualification, the construction administrative department shall handle the bidding applicant who has been found to have violated the law or violated the rules.
Article 13 These Provisions shall be interpreted by the Yichun Urban and Rural Planning and Construction Bureau.
Article 14 These Provisions shall be promulgated from May 1, 2008. The original "Interim Provisions on the Pre-qualification of the Implementation of the Public Bidding Project for Yichun City Construction Project" and the "Provisional Measures for the Bidder's Qualification of the Construction Project of Yichun City" shall be nullified at the same time.
